Please read these Terms & Conditions carefully. We provide our website as a service to our clients. By using DA Squared as your Marketing Solutions Provider and/or by accessing and using our website you agree to be bound by the Terms & Conditions stated below, and our Privacy Policy, and all disclaimers or other terms and conditions that appear elsewhere on our Website (collectively the "Agreement"). Your use of our Website constitutes your agreement to follow and be bound by the Agreement. If you do not agree to be bound by the Agreement, please do not use our Website. Although you may "bookmark" a particular portion of our Website and thereby bypass the Agreement, your use of (or clicking onto) any portion or page of our Website still binds you to the Agreement. DA Squared reserves the right to change, modify or amend these terms and conditions without any notice. DA Squared reserves the right to refuse service for any or no reason to any person or organization.

Hours of Operation
Regular business hours are 9 AM to 5 PM Pacific, Monday through Friday. We are closed on most U.S. national and State of Nevada holidays.  We will periodically close temporarily for vacation or other reasons and will post such closures on our website, or at our discretion, will notify our clients via email in advance of being temporarily closed. Orders received after hours, on weekends, holidays or during temporary closures will be processed beginning the next regular business day.

Payment
We will not carry accounts receivable or past due accounts, therefore our payment policies require either payment by credit card or payment of the full amount of each order in advance. For credit card customers, a charge will be made to your Visa, MasterCard or American Express at the time your order is approved by you, and prior to delivery or shipment of your order. A credit card receipt will print as part of the order’s invoice and will be emailed to your email address on file.  All declines will delay shipment of the order until a valid credit card is presented to our office.

Turnarounds
Although we make every possible effort to turn jobs around in the estimated times offered, your job may require more time due to unforeseeable or uncontrollable circumstances or finishing services added to the job. We will not credit customers if a job runs past the estimated turnaround time. TURNAROUND TIMES ARE AN ESTIMATE, NOT A GUARANTEE.
The following turnaround times apply to orders based on DA Squared templates on our website. Any other order is considered a custom order and turnaround time will vary for each custom order.
In general, orders that require a proof will begin processing within one business day of receipt of the order. Proofs will be submitted to customer via email within two business days of receipt of initial order. Processing of orders will not begin until all text, photographs, logos and other artwork necessary to complete the order have been submitted by Customer and received by DA Squared.
Upon receipt of approval of proof, orders for flyers and brochures will proceed to print and finish and be shipped to customer within three business days of our receipt of approval of proof.
Postcards will proceed to print and finish and be either shipped to Customer or be taken to the U.S. Postal Service for mailing within five business days of approval of proof.
Reprints without changes for flyers and brochures will proceed to print and finish and be shipped to customer within three business days of receipt of customer order.
Business cards will be shipped to Customer within seven business days of approval of proof.
Any order with a due date as being needed ASAP will be processed within the timeframe outlined above.
DA Squared will always act to make sure that delivery schedules are met; however, unexpected equipment failure, malfunction and or technical problems may delay the printing process. In case of delay caused by technical difficulty, rush charges/fees will be refunded or waived where applicable. However, technical difficulty will not be the grounds for order cancellation.

Order Submittal – New Orders on DA Squared Templates
We have created and/or provide templates on our website to expedite the ordering process. No layout or design fees will be charged for orders placed using the templates on our website. Orders submitted via fax, email or any means other than our website will be charged layout fees at $85.00 per hour (billable in 30 minute increments) and will cover all time by DA Squared until a proof is approved. Any modification of a web-based template is considered a custom order. Any order requesting our input in the placement of photos, text or other content is considered a custom order (including orders based on web templates), and design and layout fees will apply.

Order Submittal – Custom Orders
In addition to our web-based templates, we will design and print custom orders. Layout and design fees apply to all custom orders. Design and Layout Fees will be charged at $85.00 per hour (billable in 30 minute increments) and will cover all time by DA Squared until a proof is approved. Any modification of a web-based template is considered a custom order. Any order requesting our input in the placement of photos, text or other content is considered a custom order (including orders based on web templates) and design and layout fees will apply. If the completion of the custom order requires us to find and purchase stock photography, graphics, or artwork, our time for finding and purchasing such artwork will be included in design fees and the cost of obtaining the artwork will be billed to the customer. Other fees may be incurred in special circumstances.

Order Submittal – Reprints
No layout or design fees will be charged for orders reprinted without changes. A fee of $10.00 will be charged for any text change and a fee of $10.00 will be charged per photo for changes to any photo from the original order, including changing photo placement. Other fees may be incurred in special circumstances.

Order Submittal – Customer Provided Files for Printing (non-photography)
Any original media (discs, pictures, slides, proofs, etc.) are non-returnable and become our property unless other arrangements are made in advance. Preferred file type for file submission other than photography is Adobe PDF. Acceptable applications for Mac & PC include (but are not limited to) currently released versions of Adobe Illustrator, Adobe InDesign, Adobe Photoshop and Adobe Acrobat PDF. Additional charges may apply if furnished media are incompatible with our software. We cannot guarantee consistent results if files are generated by other applications like Microsoft Publisher. For best results, all rasterized files should be converted to CYMK. All fonts must be included or embedded. Images must be flattened with CMYK in JPEG, TIFF or EPS format.

Customer Submitted Photography
Except for photographs taken by David Frank Collins Photography and DA Squared, Customer is responsible for submitting and uploading all photographs to DA Squared. DA Squared will accept only JPEG files, and all photographs must be at 300 ppi resolution at the largest document size possible. DA Squared is not responsible for images printed as fuzzy, distorted or pixilated due to Customer provided photography.

Photo Editing
All Customer submitted photographs will be placed and printed as submitted by Customer. DA Squared reserves the right to make minor adjustments including changing brightness levels or other minor adjustments at our discretion, to ensure maximum print quality. DA Squared will not color correct Customer submitted photos.
Custom photo editing services are available at a fee of $150.00 per hour, billed in 15-minute increments. The minimum charge for custom photo editing services is $75.00.

Proprietary Rights
Unless otherwise noted, all written and/or other materials that are part of our Website, including information, images, illustrations, designs, icons, data, software, photographs, graphs, videos, typefaces, graphics, music, sounds and other material (collectively "Content"), are protected by copyright, trademark, patent or other proprietary rights, and these rights are valid and protected in all forms, media and technologies existing now or developed in the future. Except as expressly authorized or licensed, you may not copy, modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale, lease or rental of, create derivative works from or in any way exploit any of the Content, in whole or in part. All Content is copyrighted as a collective work under the U.S. and international copyright laws, and we own, to the fullest extent allowed by such laws, the copyright in the selection, coordination, arrangement, and enhancement of all Content. Our trademarks, logos and other trademarks on our Website are the property of their respective owners and are owned by, licensed to, or, where required, used with our permission, and, as such, may not be reproduced, copied, or manipulated in any manner without the express, written approval of the trademark owner.

Proofing Process and Order Approval
DA Squared generates an electronic proof on all orders to allow Customer an opportunity to correct errors in the layout. Any changes to proof, other than to correct errors by DA Squared are subject to Design and Layout fees or other charges. To prevent or reduce any additional charges, please carefully review your order prior to submission, including text, spelling, punctuation, grammar, and photo placement. We do not review text for content, and text will be placed exactly as submitted. We will generate the first electronic proof free of charge. The proof will be submitted via email to the customer email address on file. The email submitting the proof will either contain a link to our server that will allow the proof to be viewed through a web browser or by direct attachment of a PDF.
Except for errors caused by DA Squared, charges for the generation of additional proofs are based on the following schedule: 1) any text change, $10; 2) photo placement change or placement of new photos, $10 per photo. No order will proceed to the print and finish process until we have received an email indicating that the proof is approved. No verbal approvals will be accepted. Customer is responsible for the final proof and once the proof is approved, the order will print exactly as shown on the proof.

Rush Fees
We offer same day ship service for a rush fee charge equal to 100% of the invoice amount for the order, plus any applicable shipping and/or delivery charges. The minimum charge for rush service is $50.00, plus any applicable shipping and/or delivery charges. Due to time of day, seasonal volume and other variables, we may not be able to guarantee a same day ship status even with a rush charge.

Shipping & Delays
Completed orders will ship by the courier or shipping service selected by DA Squared, or at our discretion delivered directly by DA Squared. Orders will generally arrive within three business days after shipment. DA Squared will always act to make sure that any production difficulties do not delay delivery schedules. In no case shall DA Squared be liable for any consequential damages resulting from any delay in shipment or delivery. Next day delivery is available in some cases at a minimum additional fee of $25.00.
All DA Squared customers agree not to hold DA Squared liable for delays in shipments caused by weather conditions, shipping company delays, or any other circumstances beyond the direct control of DA Squared.
DA Squared will always act to make sure that delivery schedules are met. However, unexpected equipment failure, malfunction and or technical problems may delay the printing process. In case of delay caused by technical difficulty, rush fees will be refunded or waived where applicable; however, technical difficulty will not be the grounds for order cancellation.
DA Squared can only use its own shipping account and will not use customer provided account numbers for any couriers or delivery service. Orders must be shipped in whole quantities and may not be split up. Please note that we don't ship to Post Office Boxes.

Order Cancellation
Customer will be charged a $50.00 cancellation fee if any order is cancelled for any reason after the first proof has been submitted to Customer, but prior to Customer approval. An order cannot be cancelled or refunded after the proof is approved. Other fees may be incurred in special circumstances.

Returns & Refunds
DA Squared reserves the right to remake any product Customer finds unsatisfactory, or at our discretion, issue credit to Customer’s account in lieu of making a refund. Any Credit or Refund may be refused if Customer fails to return all unsatisfactory products to DA Squared within 5 business days.

Errors, Corrections and Changes
Occasionally there may be information on our Website that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. We reserve the right (and we will use commercially reasonable efforts) to correct any errors, inaccuracies or omissions. Additionally, we reserve the right to change or update information at any time without prior notice.

Information & Content You Submit to Us
By using our Website, you agree that any information (except for purchase information as applicable), materials, suggestions, ideas or comments you send to us or any other third party using our Website is not confidential. By submitting any solicited or unsolicited information using our Website, you grant to us and our affiliates an irrevocable and unrestricted license to use, modify, reproduce, transmit, display and distribute such materials, information, suggestions, ideas or comments for any purpose whatsoever, to the extent permitted by law.

Your Use of Our Website
Our Website and the Content are intended solely for your personal, non-commercial use. You may download or copy the Content and/or other downloadable materials displayed on the Website for your personal use only; provided that you also retain all copyright, trademark and other proprietary notices contained in the material, do not modify or alter the material and do not copy or post the material on any network computer or broadcast the material in any media. It is strictly prohibited to modify, transmit, distribute, reuse, repost, "frame" or use the Content for public or commercial purposes without written permission from an authorized representative. Tampering with our Website, misrepresenting the identity of a user, using buying agents or conducting fraudulent activities on our Website are prohibited.
